I was not eligible for insurance through my company so I signed up for for Medicaid through my state. I was eligible due to the income limits. My employer is now coming to me and saying that I am eligible for insurance through them and if I chose not to take it they said that I can only work 20 hours a week. Is this true?

Answer

Large employers have to offer coverage, but you don't have to take it. It is illegal for them to discriminate against you based on you getting cost assistance. This isn't to say that they can't cut your hours, but under the ACA the cut-off is 30 hours not 20. Seems like you have a lot of ground to barter with your employer here.

Sec. 1558. Protection for employees. Amends the Fair Labor Standards Act to ensure that no employer shall discharge or in any manner discriminate against any employee with respect to his or her compensation, terms, conditions, or other privileges of employment because the employee has received a premium tax credit or for other reasons.
