Can Employers Mandate Waiting Periods?
Can an employer mandate a waiting period before employees are eligible for Insurance coverage based on length of employment.
Answer
Sec. 2708. Prohibition on excessive waiting periods. Prohibits any waiting periods for group or individual coverage which exceed 90 days.
Waiting periods cannot exceed 90 days. If this means you will have more than a 3 month gap in coverage in a year, you'll want to look into hardship exemptions from the fee and/or get covered under a marketplace plan for those months.
