Can’t Get Same Sex Rights with Employer for Health Insurance – Story

I am the mother of a son that does not have a job although he is married and in a same sex marriage. He cannot get health insurance because his husband refuses to tell his employer to add him to the health insurance plan. I find it somewhat disabling and it actually puts him at risk. He has Hiv and needs medical attention, also mental health conditions for not having a job.. Is there an option in this case. I mean his husband can not afford insurance for both with his employer. There should be some sort of guideline for individuals with issues like this.
