The Department of Justice (DOJ) filed a motion to expedite the case against the Affordable Care Act (ACA or ObamaCare).

According to a brief filed in federal appeals court, AGs from Ohio and Montana are urging the court to throw out the ruling that declares the ACA unconstitutional. In doing this they are breaking with the Trump administration’s support of the ruling.

White House chief of staff Mick Mulvaney said people would not lose health coverage if the ACA was struck down in a lawsuit supported by the Trump administration. However, that doesn’t make sense.

The fee for not having coverage as been reduced to $0 on a federal level starting in 2019, but the side effect of that is less people obtained coverage and there is less revue to offset healthcare spending.

According to Gallup data, the uninsured rate under the Affordable Care Act (ObamaCare) rose to 13.7% in 2019 from a low of 10.9% in 2016. This seems to be due to changes to the ACA under the Trump administration.

The Trump administration has released a report called “Deregulating Health Insurance Markets: Value to Market Participants.”

Open enrollment for 2019 health plans ends December 15, 2018 in most states. Make sure to re-enroll, pick a new plan, enroll in a plan, and/or verify your plan and cost assistance by then.

Although Trump is President, you can still get health insurance with cost assistance under the Affordable Care Act each year during open enrollment. Open enrollment starts Nov 1 and ends Dec 15 in most states.

House Democrats, who won a majority in the midterms, plan to question the Trump administration’s decision not to defend the ACA in a Republican state AG backed lawsuit against the ACA.

Given the midterm elections, it looks like Medicaid will be expanded in Utah, Nebraska, and Idaho. Plus, with Dems taking the house the chances of an ACA repeal are slim for now. On top of that, Maine and Kansas elected governors who support Medicaid expansion.
