Will my Company Have to Provide Medical Benefits Even Though We are Paid Through a Payroll Company?
I work in the Entertainment Industry and we have more then 50 full time employees, however I have heard that the Employer Mandate will not affect industries like mine because we are not paid directly from the company. The company pays a payroll company that then pays us, we are all considered at will employees and are W2. Will they have to provide benefits or will they be able to get around this?
That is a good question. From what we understand the employer has to use reasonable methods of crediting full-time equivalent hours. Some types of employees don't have to be credited, or are credited differently. There very well may be a loophole in here that applies. If anyone has specifics on this, please comment. In the meantime we will continue to look and report back when we have a more specific answer.
