Does an Employer Have to Offer Coverage if I Have Coverage?
If I work at a 50+ employee job and I am going from a full time job to a part time job does my employer have to offer me insurance if I had it as a full time employee.
Answer
A qualifying employer must offer health coverage regardless of what other coverage options an employee has. The requirement to offer coverage is based solely on the number of full-time equivalent employees working for the employer. If the employer must provide coverage (is a qualifying employer in regard to the mandate) then they must offer coverage to all employees who qualify as full-time.
