The Next Supreme Court Justice Matters in Terms of Healthcare Too
The Affordable Care Act’s future is on the line with the next Supreme Court justice pick. Kennedy’s retirement means he will be replaced. A right wing judge could swing the courts against the ACA and more.
The logic is simple, key provisions of the ACA regularly make it to the Supreme Court. If the Trump administration is able to stack the court with right-wing judges, as seems to be the intention, then the Affordable Care Act is likely to start losing some court battles. This could result in the end of the ACA as we know it under Trump without the Republicans ever needing to pass an actual repeal and replace in Congress.
To hammer in the point, right now 20 states are suing the federal government charging that without the mandate the ACA is illegal. Trump’s administration actually removed the mandate themselves and now won’t defend the law. Between that case and the justice pick alone we could effectively see the end of preexisting conditions protections in the United States. That is just one example of what is on the line.
