What Are Disability Requirements for MAGI?
Do people with disabilities have a different MAGI requirement than non disabled?
When I signed up for ACA I was denied because my MAGI was too high, but when I clicked on “disabled” I was accepted. Now I am told by the tax preparer that I have to pay it all back. $5700.
Answer
Social Security Disability payments count as income for MAGI. Medicaid doesn't count this income, but the Marketplace cost assistance does. Disabled status shouldn't have had an impact on the amount of tax credits you received alone. Tax credits are based on income, so the only way to owe back the full tax credit like that is to have protected below 400% of the Federal Poverty Level and then to have claimed over it.
